Terms of Service

These terms govern your use of UpNTop. By creating an account or using the service you accept them.
1. Who we are
UpNTop is operated by Denis Malov s.p., Mlinska ulica 22, 2000 Maribor, Slovenia.

2. What the service does
UpNTop measures how your sites are seen — search visibility, presence in AI answers, page speed, availability and technical audit — drafts content for them, keeps a queue of placements and directories, and sends email campaigns from your own domain.
Which parts are available to you depends on your account. We may add, change or withdraw features, and we describe what a number means rather than inventing a single score out of it.
3. Accounts
You must be at least 16 years old to use the service.
Keep your credentials to yourself. You are responsible for what happens under your account, including actions of the people you invite into it.
An account may hold several sites. Data of one account is not shown to another.
4. Acceptable use
Do not use the service for illegal, infringing, deceptive or harmful material, and do not point published content or links at such material.
Do not disrupt or overload the service, do not try to reach data of other accounts, and do not resell access as your own product without our agreement.
The service talks to third-party interfaces on your behalf — search consoles, directories, publishing platforms. Their terms apply to that traffic too, and you may not use us to get around them.
We may suspend content or an account that breaches these terms or the law.
5. Sending email
You may write only to people who agreed to hear from you. Purchased, scraped or rented lists are not allowed, and neither is importing an address list whose consent you cannot show.
Every campaign carries a working unsubscribe link and a one-click unsubscribe header. Removing them is a breach of these terms.
Each account has a suppression list: addresses that unsubscribed, complained or hard-bounced are not written to again. It cannot be switched off, and an address on it stays there after the contact is deleted.
Sending shares an infrastructure and a reputation with other customers. We may throttle or stop sending when complaints, bounces or volume threaten that reputation, and we will tell you why.
6. Your data
You keep the rights to what you upload and publish. You grant us the limited right to store and process it in order to run the service for you.
For the contacts and campaigns you bring, you are the controller and we act as your processor on your instructions — see the Privacy Policy. A written data processing agreement is available on request.
You can export your data and delete your account at any time.
7. Fees
The service is currently provided free of charge while it is in early access. We take no payments and store no card details, and there is no payment processor involved.
Prices shown on the site describe planned paid plans. Before anyone is charged we will publish the payment terms, name the payment processor, and ask for your agreement — a plan does not start costing money quietly.
8. Our own rights
The service, its software, design, texts and name remain ours. These terms let you use the service and grant you nothing else in it.
9. Availability and what depends on others
The service is provided as it is and as available. We aim high but do not promise uninterrupted or error-free operation.
Much of what you see comes from other people’s interfaces: search metrics from Google and Microsoft, speed from Google, generation from Anthropic. Their limits, outages and rule changes affect what we can show. A gap in a chart can mean their quota rather than a change on your site, and where we can tell the difference we say which one it is.
We may modify, suspend or discontinue parts of the service, with reasonable notice of material changes where practicable.
10. Termination
You may stop using the service and delete your account at any time.
We may suspend or close an account that breaches these terms or the law. Export what you need beforehand: after closure, monitoring stops, campaigns stop, and stored data is deleted as described in the Privacy Policy.
11. Liability
To the extent the law allows, we are not liable for indirect or consequential damage, lost profit or lost data, and our liability is limited to what you paid us for the service in the twelve months before the claim.
Nothing here limits liability that cannot be excluded, including for intent and gross negligence, nor your statutory rights as a consumer.
12. Law and disputes
These terms are governed by the law of the Republic of Slovenia, without its conflict-of-law rules. The courts of Maribor have jurisdiction, subject to mandatory consumer protections in your country of residence.
EU consumers may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
13. Changes and contact
We may update these terms, will publish the new version with a new date, and will notify account holders of material changes. Continued use after they take effect means you accept them.
